Legislation would limit ditch riders

PIERRE — Drivers of all-terrain vehicles could be banned from ditches along some county roads under legislation approved 32-1 Thursday by the state Senate.
The measure was introduced after legislators got reports of ATVs tearing up ditches in some areas of South Dakota.
Because it is not illegal to ride ATVs in ditches, authorities could do nothing about it.
HB1084 would allow county commissioners to prohibit the operation of off-road vehicles in ditches along county roads, but not state highways, said Sen. Garry Moore, D-Yankton, said.
Counties passing ordinances to ban ATVs in ditches would have to post signs along those road stretches and at each intersection, he said.
Farmers and utility crews would be exempt from the regulation, Moore said.
Legislators have been told that some ATV drivers are using driveways in ditches for ramps, and those driveways to private property are being torn up.
HB1084 initially would have allowed counties to confine all-terrain vehicles to road shoulders or roads, if the vehicles were licensed. The measure was changed in the Senate and must be returned to the House to see if it agrees to the changes.
