St. Francis man convicted on second sex offense

A St. Francis man who pleaded guilty to incest in 1996 has been convicted of sexual abuse for having sex with a woman who was not capable of giving her consent.

Keith Eric Hawkman Sr., 38, was convicted in a federal jury trial in Pierre. He was charged with raping a woman in Todd County on May 14, 2006.

Federal court documents show Hawkman pleaded guilty to a charge of incest in 1996 and was sentenced to 16 months in prison, three years' supervision and a $500 fine. Four additional charges of incest and five charges of sexual abuse of a minor were dropped in exchange for his plea. Further details of that case were not available.

Because of Hawkman’s previous conviction for a sex offense, prosecutors say he faces up to 40 years in prison and a $250,000 fine for the sexual abuse charge.

Hawkman is already in prison for assaulting a man with a club on Feb. 12, 2006, in Todd County. He was sentenced last February to 70 months in prison after pleading guilty to assault with a dangerous weapon.

Hawkman will be sentenced on the sexual-abuse charge May 2.

In other federal court news:

-- Tracy Lee Garreau, 43, Eagle Butte, was sentenced by U.S. District Judge Karen Schreier to six months' home confinement, three years' probation and a $500 fine for harboring a federal fugitive. Garreau hid her brother, Sydney Garreau, while he was on the run from law enforcement after walking away from Community Alternatives of the Black Hills last spring. Sydney Garreau was the subject of a two-week manhunt before his arrest. At the time, officials said he was armed and dangerous and wanted for questioning in the assault of a South Dakota Highway Patrolman. Tracy Garreau pleaded guilty to harboring a fugitive. Her brother pleaded guilty to escape and to an assault charge connected with another incident that happened while he was on the run. He is scheduled for sentencing Feb. 25.

-- Larry Jongewaard, 40, Omaha, Neb., was convicted by a jury of violating interstate communications law by making threats to kill his uncle, who lives near White River. The maximum penalty is five years in prison and a $250,000 fine. He was detained pending sentencing May 2.

-- Harold Standing Bear, 43, Norris, pleaded guilty to a charge of conspiracy to distribute and possession with intent to distribute marijuana. According to a news release from the U.S. Attorney’s Office, the charges involve incidents between July 1, 2005, and July 1, 2007. The maximum penalty is five years in prison and a $250,000 fine. He was released on bond pending sentencing.

-- Jesse J. “Chops” Eagle Elk, 44, St. Francis, pleaded guilty to abusive sexual contact. According to a news release from the U.S. Attorney’s Office, the charge involved the sexual abuse of a Mission woman in December 2006. The maximum penalty is three years in prison and a $250,000 fine. Eagle Elk was detained pending sentencing May 2.

-- Frank J. White Thunder, 20, Mission, pleaded guilty to abusive sexual contact in connection with a January incident involving a Todd County woman. The maximum penalty is three years in prison and a $250,000 fine. He was detained pending sentencing May 2.

-- Rose Marie Adams, 51, Rapid City, pleaded not guilty to a five-count indictment charging her with conspiracy to distribute a controlled substance, distribution of a controlled substance, and possession with intent to distribute a controlled substance. Federal court documents show that she is accused of distributing oxycodone between June 2006 and October 2007 at Rapid City. Other charges involve marijuana distribution. The maximum penalty upon conviction for conspiracy is 20 years in prison and a $1 million fine. Distribution carries a mandatory minimum sentence of five years in prison, with a maximum of 40 years, and a $2 million fine. Adams was detained pending trial.

-- Shaun Kyle Mills, 23, of Rosebud, and Maza Grassrope, 20, of Lower Brule, pleaded not guilty to assault with a dangerous weapon and assault resulting in serious bodily injury. Federal court documents show they are accused of assaulting a person at Lower Brule on July 23, 2006. If convicted, each could face up to 10 years in prison and a $250,000 fine. Both were released pending trial.
