An Eagle Butte man who witnessed a serious assault but failed to report it has been sentenced to 12 months and one day in prison.
Samuel LeBeau, 31, was sentenced by U.S. District Judge Karen Schreier after pleading guilty to misprision of a felony.
LeBeau watched while Sydney Garreau, who was a federal fugitive at the time, assaulted Bryan Lawrence at a home in Eagle Butte on March 17. Lawrence had provided information that led to Garreau's 2000 conviction for brandishing a firearm during a crime of violence. LeBeau did not report the crime.
Garreau, 28, has pleaded guilty to retaliation against a federal witness and to escape. Another man involved in the assault, Jeremy DeCoteau of Eagle Butte, pleaded guilty to assault with a dangerous weapon aiding and abetting. Both men are awaiting sentencing.
