Man charged with breaking infant’s arm

An Allen man accused of breaking an infant’s arm has been charged with assault.
Lane Yellow Hawk, 32, pleaded not guilty in U.S. District Court to a charge of assault resulting in serious bodily injury.
According to federal court documents, he is accused of grabbing the arm of a young child, causing a spiral fracture in the upper arm. Prosecutors say the incident happened Feb. 12 at Allen.
A conviction of the charge carries a mandatory minimum penalty of 10 years in prison, with a maximum of life in prison, plus a $250,000 fine.
Yellow Hawk's trial is set for April 29.
In other federal court news:
* Stacee Farmer, 31, Mission, was sentenced by U.S. District Judge Charles Kornmann to two years in prison and three years' supervised release. She pleaded guilty to conspiracy to distribute and possess with intent to distribute a controlled substance in connection with a methamphetamine distribution conspiracy that occurred between Jan. 1, 2005, and May 11, 2006.
* Brad Waechter, 39, Mobridge, was sentenced by Kornmann to 12 months and one day in prison and three years' supervised release for possession with intent to distribute marijuana. Waechter pleaded guilty to the charge.
* Clyde White, 43, Fountain, Fla., was convicted by a jury of being an unlawful user of a controlled substance in possession of a firearm. According to a news release from the U.S. Attorney’s Office, the charge involved an incident on Aug. 12, 2006, at Badlands National Park when White, an unlawful user of cocaine and marijuana, knowingly possessed a Beretta 9 mm pistol. The maximum penalty is 10 years in prison and a $250,000 fine. Sentencing was set for May 13.
* Julian Brown Eyes, 34, Rapid City, pleaded guilty to felon in possession of a firearm. According to a news release from the U.S. Attorney’s Office, Brown Eyes, a felon, possessed a .45-caliber semiautomatic pistol while standing in the parking lot of an apartment complex when police officers approached him on Nov. 9, 2007. Sentencing will be May 20.
* Nephi Sky Antelope, 21, Little Eagle, pleaded guilty to assault with a dangerous weapon. Federal court documents show that Antelope admitted to using shod feet to assault a Little Eagle man last August. The maximum penalty is 10 years in prison and a $250,000 fine. Antelope remains in custody until sentencing May 19.
* Pleaz Hawkins, 20, Pine Ridge, pleaded not guilty to a three-count indictment charging him with aggravated sexual abuse for allegedly trying to have sexual relations with a girl younger than 12 years old. Federal court documents show the alleged incidents happened between Sept. 1 and Dec. 31 in Pine Ridge. An aggravated-sexual-abuse conviction carries a mandatory minimum sentence of 30 years in prison, with a maximum of life in prison, and a $250,000 fine. Trial is set for May 6.
* Samuel White Horse, 19, Cherry Creek, pleaded not guilty to an indictment charging him with assaulting, resisting or impeding certain officers. According to federal court documents, he is accused of assaulting a Cheyenne River Sioux tribal police officer on Jan. 1 at Cherry Creek. The maximum penalty upon conviction is 20 years in prison and a $250,000 fine. Trial is set for April 30.
* Larry Short Horn, 48, Kyle, pleaded not guilty to escape. According to the indictment, Short Horn was furloughed from Federal Correctional Complex in Florence, Colo., and ordered to “present himself for further confinement” at Behavior Management Systems by Jan. 16. He did not present himself and was arrested March 4. Court records show Short Horn was sentenced in 2003 to 78 months in prison for assault. Upon conviction, escape is punishable by up to 10 years in prison and a $250,000 fine. Short Horn was detained pending trial May 13.
