Custer biker gunfight trial may be delayed, moved

Prosecution and defense lawyers handling the 2006 Custer State Park biker shooting will take up several pretrial motions Tuesday in Rapid City, including one that will likely move the trial to Sioux Falls.
Chad Wilson of Washington state and John Midmore of Indiana are each charged with seven conspiracy, murder and gun counts for the shootout that injured six rival Outlaw gang members.
Defense lawyers filed a request for a change of venue because they believe the men can't get a fair trial in Custer County due to pretrial publicity. Prosecutors aren't opposing it because of safety and logistic concerns over the Custer courthouse.
The defense also asked for a short delay in the trial to Nov. 3 so a key expert witness is available.
