Hells Angel released from hospital

The Hells Angel who was shot during a barroom fracas at the 2008 Sturgis motorcycle rally has been released from Rapid City Regional Hospital.

Joseph Patrick McGuire, 33, was hospitalized Aug. 9 after being shot at the Loud American Roadhouse in Sturgis.

McGuire was released from Regional before testifying about the shooting in front of a grand jury Aug. 27, according to a recent e-mail to the Journal from Meade County State's Attorney Jesse Sondreal.

Details about McGuire's condition had not been released, and he had not been listed in the hospital's directory. It is unknown whether he pursued further treatment for his injuries or went to another hospital.

Seattle police detective Ronald Smith, 43, has admitted to shooting McGuire inside the packed bar during a scuffle between the Iron Pigs and Hells Angels at the Sturgis bar.

Smith, who has claimed he shot McGuire in self-defense, was briefly detained and questioned, then allowed to return to Washington.

He was indicted on felony charges of assault and perjury.

The perjury charge was dropped this week, but Smith is still charged with aggravated assault, which is a felony, and one count of carrying a concealed weapon without a permit, which is a misdemeanor.

McGuire, who lives in Imperial Beach, Calif., has also been indicted on one count of aggravated assault.

Both men face an alternate count of simple assault. They can be convicted of one of the assault charges but not both.

Four other bikers were indicted on misdemeanor charges. At least three of them are members of the Iron Pigs, which is a national motorcycle club of police and firefighters. Smith is also an Iron Pigs member.

A Meade County grand jury heard testimony on two different occasions from several people who were at the scene before handing down the charges.

Warrants were issued in late August for all of the men who were indicted. Sondreal said he expects them to surrender to authorities voluntarily.

"We've been in contact with representatives from the defendants, and we expect turn-ins to take place relatively soon," he said in an e-mail.
