Hells Angels conspiracy charge still looming

Prosecutors have a week to decide whether to pursue a second trial against two Hells Angels bikers acquitted of trying to kill five people affiliated with the Outlaws Motorcycle Club.

Chad Wilson of San Diego and John Midmore of Valparaiso, Ind., were found not guilty Nov. 20 in Sioux Falls of attempted first-degree murder for a 2006 gunfight at Custer State Park.

Midmore is out on bail, but Wilson was charged in federal court with being a nonimmigrant alien in possession of a firearm and transferred to Sioux Falls.

The judge handling the state charges gave prosecutors until Jan. 15 to indicate if they want to try both men of conspiracy to commit first-degree murder, which carries a punishment of life in prison if convicted.
