Man pleads guilty in rape of Lead-Deadwood student

DEADWOOD - Juan Miguel Otero, 22, of Chicago faces up to 65 years in the South Dakota State Penitentiary after pleading guilty Tuesday to rape and possession of child pornography.

He pleaded guilty to three counts of fourth-degree rape, a Class 3 felony with the maximum sentence for each count 15 years in the state penitentiary, a $30,000 fine or both. And he pleaded guilty to two counts of possession of child pornography, a Class 4 felony, each count carrying a maximum sentence of 10 years in the state penitentiary, a $20,000 fine or both.

Nine other charges were dismissed in exchange for Otero's plea.

Actions stem from incidents involving a Lead-Deadwood High School student between ages 13 and 16. A grand jury indictment said the rapes occurred Aug. 15 and 16, 2008, and Feb. 10-12, 2009.

Otero will remain in the Lawrence County Jail in Deadwood until his sentencing, which is set for 11 a.m. Thursday, Oct. 1.

Lawrence County Deputy State's Attorney Amber Richey said the victim's family knows about the plea agreement and agrees with it.

The Lawrence County Court Services Office will now begin a presentence investigation on Otero. That will provide Fourth Circuit Judge Randall Macy with guidelines for the appropriate sentence.

County Public Defender Eric Whitcher said after the hearing the investigation will help determine what type of person Otero is. He said a lot of misinformation has circulated about his client.

The guilty plea means there will not be a trial as was scheduled Sept. 1-2.
