The Sioux Falls judge handling the trial of two Hells Angels bikers charged with trying to kill five rivals is considering whether to acquit one of the defendants.
After prosecutors finished their case Friday, the defense argued the state failed to prove its case against Chad Wilson of Lynnwood, Wash., and John Midmore of Valparaiso, Ind.
Judge Gene Paul Kean denied the acquittal motion, saying there are gaps in the testimony but the evidence is not so lacking.
The defense then asked for an acquittal on Midmore only, arguing prosecutors only showed he was in the truck with Wilson.
The prosecutor said Midmore assisted.
But the judge said he would reserve judgment on the request because Midmore's situation is different.
