Men to serve time for Rosebud rape

  • Marta Trickey, 51, Rapid City, was sentenced by Schreier to time served, one year of home confinement and five years of supervised release for selling methamphetamine. According to a news release from the U.S. Attorney's Office, Trickey pleaded guilty to possession with intent to distribute a controlled substance.
  • Phillip J. Little Hoop, 26, Parmelee, pleaded guilty to a one-count indictment charging him with sexual abuse of a minor. Federal court documents show he admitted to a sexual act with a girl who was between 12 and 16 years old in early November 2006. The maximum penalty is 15 years in prison and a $250,000 fine. Little Hoop is in custody pending sentencing.
  • Tyrall Cadotte, 23, Wakpala, pleaded guilty to a charge of assault resulting in serious bodily injury, admitting that he used a motor vehicle to assault a Wakpala man on July 17, 2007. The maximum penalty is 10 years in prison and a $250,000 fine. Cadotte is in custody pending sentencing Dec. 8.
  • John Red Feather Sr., 56, Pine Ridge, pleaded not guilty to a three-count indictment charging him with aggravated sexual abuse. According to federal documents, he is accused of having sexual contact with girls younger than 12 in 2005, 2006, 2007 and 2008 near Pine Ridge. Two of the counts are punishable by a mandatory minimum sentence of 30 years in prison, with a maximum of life in prison and a $250,000 fine upon conviction. The third count is punishable by up to life in prison and a $250,000 fine upon conviction. No trial date was set.
  • Shaun Chosa, 27, Rosebud, has been indicted on a charge of conspiracy to distribute and possess with intent to distribute a controlled substance. Federal court documents show the charges involve the alleged distribution of methamphetamine between Jan. 1, 2004, and March 28, 2008. If convicted, he would face a mandatory minimum sentence of five years in prison.
  • Shane Cook, 29, Eagle Butte, was indicted on two counts of conspiracy to distribute and possess with intent to distribute a controlled substance and one count of conspiracy to distribute a controlled substance. Federal court documents show he is accused of conspiring to distribute cocaine, methamphetamine and marijuana between Jan. 1, 2003, and Feb. 29, 2008. The first two charges carry maximum penalties of 20 years in prison and a $1 million fine upon conviction. The third count is punishable by five years in prison and a $250,000 fine upon conviction.
  • Amy V. Schmidt, 28, no residence listed, pleaded not guilty to a 14-count indictment charging her with theft of mail matter and obstruction of correspondence. Federal court documents show she is accused of taking letters, postcards and packages intended for other recipients from mailboxes. Prosecutors say she took mail addressed to credit card companies, cell phone companies and other recipients on Feb. 11. The maximum penalty upon conviction is five years in prison and a $250,000 fine, plus restitution. No trial date was set.

Editor's note: The U.S. District Court generally prosecutes felonies committed on reservations, while tribal courts handle misdemeanor crimes. Felonies that happen off the reservation are prosecuted in state/circuit court and are reported separately in the Journal. Some drug and firearms cases are also prosecuted in federal court.
