A South Dakota Highway Patrol trooper who killed a man after a chase near Harrold in October is being sued by the man's fiancee.
Trooper Ryan Lantz shot Anthony Larocco when he aimed a gun at short range at officers. Although a pellet gun, it closely resembled a .380-caliber semiautomatic pistol.
Gerry Ogle, who had two children with Larocco, alleges in her lawsuit that Lantz violated Larocco's constitutional rights by using excessive force to subdue him.
Ogle, of Washburn, Mo., has requested a jury trial and is seeking unspecified damages.
Lantz was cleared by the attorney general of wrongdoing in the shooting.
