Defandant waiting on housing to ask for bond

RAPID CITY - The Rapid City man charged in the death of an 18-month-old boy is waiting for his grandmother to find housing so he can ask 7th Circuit Judge Merton B. Tice for bond to be set.

Matthew Potter, 20, has been in Pennington County Jail without bond since he was arrested Jan. 17, when Rapid City Police responded to a call and found the toddler, Tanner Jurisch, unconscious. Jurisch died the next day.

Attorneys are working on setting up interviews with Rapid City physicians about the toddler's injuries.

Potter pleaded not guilty in January to one count of second-degree murder, two alternate counts of first-degree manslaughter and one count of aggravated child abuse.

Second-degree murder has a mandatory sentence of life in prison, and first-degree manslaughter is punishable by a maximum sentence of life in prison.

The aggravated child-abuse charge, which Potter could be convicted of in addition to one of the other counts, is punishable by a maximum sentence 15 years in prison.

Potter's next hearing is June 8.
