An oil refinery planned for Elk Point could be the biggest such project ever the state, but the Public Utilities Commission apparently doesn't have a say where it goes.
Commissioner Gary Hanson says state law doesn't give the panel authority over the Hyperion Resources refinery itself, but it would have to approve any pipelines to it, as well as an energy plant and power lines.
That means approval lies with Union County officials.
The county planning commission recommended that commissioners approve the Texas company's request to turn 3,800 acres north of Elk Point into a planned development district for the $10 billion oil refinery.
